What information do we collect?
A. Information you provide to us
When you submit an application, contact us, or otherwise interact with the Site, you may voluntarily share personal information including your name, business name, telephone numbers, email and mailing addresses, role at the business, contact preferences, account credentials, and billing details. You confirm that any information you provide is true, complete, and accurate, and you agree to update us if it changes.
B. Sensitive information
With your consent, or where permitted or required by law, we may process sensitive personal information necessary to evaluate a funding request — including financial statements, bank records, creditworthiness indicators, tax identification numbers, Social Security numbers, and other government-issued identifiers.
C. Information from other sources
To verify applications and improve our outreach, we may also receive information from third-party sources such as public records, credit bureaus, identity-verification providers, banking-data aggregators, marketing partners, data resellers, and public profiles on professional networks. This may include mailing addresses, role and employer information, email and phone numbers, IP addresses, intent and engagement data, and similar identifiers used for targeted communications and event invitations.
How do we process your information?
We process information for the following purposes, relying on your consent, the performance of a contract with you, compliance with our legal obligations, or our legitimate interests:
- To evaluate funding applications, underwrite credit, and deliver services.
- To communicate with you regarding your application, account, or relationship with us.
- To send targeted communications about products and events that may interest you.
- To improve, secure, and administer the Site and our services.
- To detect, investigate, and prevent fraud, abuse, and other unlawful activity.
- To comply with applicable laws, regulations, and lawful requests from authorities.
- For any other purpose disclosed to you and to which you have given consent.
When and with whom do we share your personal information?
We may share personal information in the following circumstances:
- Service providers. Vendors that help us operate the business — identity verification, banking-data analysis, payment processing, hosting, analytics, customer support — bound by written confidentiality and data-use contracts.
- Capital partners and assignees. Parties that participate in, acquire, syndicate, or service a funded facility.
- Affiliates. Parent companies, subsidiaries, and joint ventures bound by this notice or equivalent obligations.
- Business transfers. Counterparties to a merger, sale, reorganization, financing, or comparable transaction involving all or part of ByzCap.
- Legal compliance. Regulators, courts, and law enforcement where disclosure is required by law or to protect rights, safety, or property.
How long do we keep your information?
We keep personal information only as long as necessary to fulfill the purposes described in this notice — including the duration of your relationship with us, ongoing servicing of any facility, and any legal, tax, accounting, or reporting obligations that apply. When no legitimate business need remains, we delete or anonymize the data, or, where deletion is not immediately possible, securely store and isolate it until deletion can occur.
How do we keep your information safe?
We maintain administrative, technical, and physical safeguards designed to protect personal information. No system is perfectly secure, however, and no transmission over the internet or method of electronic storage can be guaranteed against unauthorized access, alteration, disclosure, or loss. You access the Site and submit information at your own risk and should do so only within a secure environment.
Do we collect information from minors?
The Site and our services are directed to operating businesses and their principals. We do not knowingly collect personal information from, market to, or solicit data from individuals under 18. You represent that you are at least 18 or acting with appropriate authority on behalf of a business. If we learn that we have collected information from a minor, we will deactivate the account and promptly delete the information. What are your privacy rights?
Where processing is based on consent, you have the right to withdraw that consent at any time by contacting us using the details below. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal, nor does it affect processing carried out on other legal bases. Controls for Do-Not-Track features
Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature. Because no uniform technology standard for recognizing and implementing DNT signals has been finalized, we do not currently respond to DNT browser signals or any other mechanism that communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will update this notice accordingly.
Do United States residents have specific privacy rights?
If you reside in a state with comprehensive consumer privacy legislation — including California, Virginia, Colorado, Connecticut, Utah, Delaware, Florida, Oregon, Texas, or any other state with substantially similar laws in force — you may have additional rights.
A. Categories of personal information collected
In the past twelve months, we have collected the following categories of personal information: identifiers (e.g., name, contact details); commercial information (e.g., transaction history with us); financial information; professional or employment-related information; characteristics protected under state or federal law where voluntarily provided; and inferences drawn from the foregoing. We collect this information directly from you, from your authorized representatives, from public sources, and from the third parties described in Section 1. We retain it for as long as you maintain a relationship with us or as required by law.
B. Sources, use, and sharing
The sources of the information are described in Section 1, the purposes of processing in Section 2, and the recipients in Section 3. We do not sell personal information for money, and we have not sold or shared personal information for cross-context behavioral advertising in the preceding twelve months. We do not intend to do so in the future without first updating this notice and providing any required opt-out.
C. Your rights
Depending on your state of residence, you may have the right to:
- Confirm whether we process your personal information.
- Access the personal information we hold about you.
- Correct inaccurate personal information.
- Request deletion of your personal information.
- Obtain a portable copy of information you previously provided.
- Opt out of targeted advertising, the sale of personal information, or certain profiling.
- Receive a list of categories of third parties to whom we disclosed personal information (California, Delaware).
- Receive a list of the specific third parties to whom we disclosed personal information (Oregon).
- Limit our use or disclosure of sensitive personal information (California).
- Opt out of collection or processing of voice or facial-recognition data (Florida).
- Not be discriminated against for exercising any of these rights.
D. How to exercise your rights
You may submit a request by emailing funding@byzcap.com or calling 212-618-1270. Authorized agents may submit requests on your behalf with valid written authorization. We may decline an agent request that does not include adequate proof of authority.
E. Verification
To protect your information, we will verify your identity using information you provide in your request together with data already in our records. If we cannot verify your identity from existing information, we may request additional details. For agent requests, we may also require written permission signed by you.
F. Appeals
If we decline your request, you may appeal by emailing funding@byzcap.com with the subject line "Privacy Appeal." We will respond in writing with the action taken and the reasons for our decision. If you remain dissatisfied, you may have a right to contact your state attorney general.
G. California "Shine the Light"
California Civil Code Section 1798.83 permits California residents to request, once per year and free of charge, a list of the categories of personal information disclosed to third parties for those parties' direct marketing purposes in the preceding calendar year, along with the names and addresses of those third parties. To make a request, write to us using the contact details in Section 11.
Do we make updates to this notice?
Yes. We will update this notice as necessary to remain compliant with applicable law and to reflect changes in our practices. The "Revised" date at the top of this notice indicates when it was last updated. For material changes, we may also notify you by a prominent notice on the Site or by direct communication. We encourage you to review this notice frequently.
